1. Acceptance of Terms

By using the Jolene Assistant SMS messaging service ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. By providing your phone number and opting into the Service, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

2. Description of Service

The Service is an AI-powered automated messaging platform that sends scheduling reminders, notifications, and alerts to users via SMS. Messages are triggered programmatically by the application based on user-configured preferences and calendar events.

The Service operates as an Application-to-Person (A2P) messaging platform. All messages are initiated programmatically by the application, not manually by an individual. The Service is provided on an ongoing basis subject to these terms.

3. SMS Messaging — Consent, Frequency, and Opt-Out

3.1 How You Consent to Receive Messages

Before receiving any automated SMS messages, you must provide prior express written consent. Consent is obtained through one of the following methods:

Direct Invitation Opt-In: A known individual invites you to the Service. You reply with an explicit consent message (YES or START) to a one-time invitation SMS, which clearly discloses:

Web-Based Opt-In: You enter your phone number into a web form with a clearly labeled, unchecked-by-default checkbox stating: "I consent to receive automated SMS messages from Jolene Assistant. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe, HELP for help. I agree to the Privacy Policy and Terms of Service." You must actively check the box and submit the form, then reply YES to a confirmation SMS.

No Automated Opt-In. We do not use pre-checked boxes, automatically enroll users, or obtain consent through bundled agreements. All consent requires affirmative, deliberate action by the end user.

3.2 Message Frequency

Message frequency varies based on your configured reminders, notifications, and interactions with the Service. Typical message volume ranges from 1-10 messages per day depending on your settings and activity. You control what triggers messages through your preferences.

3.3 Opt-Out — STOP and HELP

You may stop receiving messages at any time by replying STOP to any SMS from the Service. Opt-out is immediate and unconditional. After opting out, you will receive a single confirmation message and no further messages will be sent to your number.

3.4 Supported Carriers

Supported carriers include, but are not limited to: AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, Boost Mobile, Cricket, Metro by T-Mobile, and other major U.S. carriers. The Service is not responsible for delayed or undelivered messages due to carrier issues, network congestion, or device problems.

3.5 Message and Data Rates

Standard message and data rates may apply as determined by your mobile carrier and service plan. You are responsible for any charges from your carrier related to SMS messages sent or received through the Service.

3.6 Non-Sharing of Mobile Information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are excluded from any data sharing; this information will not be shared with any third parties. Twilio, Inc. processes your phone number and message content solely as our service provider for SMS message routing and delivery.

4. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. The Service is intended for use within the United States.

The Service, including its underlying software, name, and branding, is owned by the Service provider. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose — receiving and responding to automated scheduling and notification messages.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE PROVIDER AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, DATA LOSS, MISSED APPOINTMENTS, UNDELIVERED NOTIFICATIONS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold harmless the Service provider and its affiliates from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

We reserve the right to modify, suspend, or discontinue the Service, or any part thereof, at any time with or without notice. We will make reasonable efforts to notify active users of material changes via SMS.

We reserve the right to update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. We will notify active users of material changes via SMS. Continued use of the Service after changes are posted constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Medina County, Ohio.
